Vaccine Program Delays Leave Injured Victims Waiting



On November 14, 2019, the United States Court of Federal Claims held its annual conference that was compromised of sessions dealing specifically with vaccine injury claims. The conference was attended by attorneys representing those injured by vaccines, the vaccine special masters/judges, the Department of Justice attorneys, and representatives from the Department of Health and Human Services. During the vaccine sessions, it was reported that there was a massive backlog of cases, mainly due to the surge in reported SIRVA (shoulder injuries related to vaccine administration) cases. The Court reported that in the fiscal years of 2016-2019, the Court has seen 1,120, 1,243, 1,238 and 1,282 cases filed, respectively. This is in stark contrast to the 504, 633, and 803 vaccine cases that were filed in 2013, 2014 and 2015, respectively. The rapid increase in case filings and the lack of scaling in personnel by the Department of Justice, the Department of Health and Human Services and the Court has resulted in a backlog of filed cases. While the Department of Justice and the Court have taken steps to recruit and hire more personnel to address the backlog, there exists a real issue with the Department of Health and Human Services, which is still seeking funding in order to hire additional medical reviewers to review vaccine cases. Currently, the Department of Health and Human Services is reporting a delay of approximately six (6) months in reviewing a case after it has been filed.
